1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "you"), and Serial Scaler, LLC, doing business as No Carpet Stays ("Company", "we", "us", "our"), concerning your access to and use of the No Carpet Stays website and application (collectively, the "Service").

By accessing or using the Service, you agree that you have read, understood, and accept all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

By using the Service, you represent and warrant that:

• You have the legal capacity and you agree to comply with these Terms.
• You are not a minor in the jurisdiction in which you reside (generally under 18).
• You will not use the Service for any illegal or unauthorized purpose.
• Travel Documents: You are solely responsible for ensuring you meet all foreign entry requirements (Visas, Passports, Health) and that your travel documents are in order.
• Medical Needs: You acknowledge that No Carpet Stays gives no medical advice. If you have severe allergies, you must take appropriate medical precautions independent of our data.

4. Prohibited Activities

The content and data on the Service (including the database of floor type classifications) is proprietary to us. You agree not to:

• Data Mining/Scraping: Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Reverse Engineering: Decipher, decompile, disassemble, or reverse engineer any of the software comprising the Service.
• Bot Usage: Use any robot, spider, or interface not provided by us to access the Service.
• Resale: Use the Service for any commercial endeavors, including selling access to our data.

5. Booking Services & Payment

5.1 Third-Party Facilitation

No Carpet Stays acts as an interface and affiliate. We facilitate bookings through third-party partners (such as LiteAPI, Booking.com, Expedia). We are not the Merchant of Record.

5.2 Contract with Supplier

When you make a booking, your contract is directly with the Travel Supplier (Hotel) or the Booking Aggregator. Your booking is subject to the Terms and Conditions of that Supplier (including cancellation policies, refund rules, and house rules). Please review them carefully.

5.3 Financial Liability

We accept no liability for any issues arising from the booking transaction, including:

• Payment processing errors.
• Double charges or refunds.
• Hotel overbooking or cancellation of your reservation by the Supplier.

6. Intellectual Property Rights

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") are owned or controlled by us and are protected by copyright and trademark laws.

7. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF APPLICABLE LAW DOES NOT ALLOW ALL OR ANY PART OF THE ABOVE LIMITATION OF LIABILITY TO APPLY TO YOU, THE LIMITATIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

8. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms.

9. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

10. Governing Law

These Terms shall be governed by and defined following the laws of [Your State], United States. Serial Scaler, LLC and yourself irrevocably consent that the courts of [Your State] shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
